3. Service Descriptions

Information on our website about active break packages, including Starter Pulse, Professional Flow, and Enterprise Momentum, is provided for general guidance. Programme details, session frequencies, pricing, and deliverables are confirmed in individual service agreements. We endeavour to ensure accuracy but do not warrant that all website content is complete, current, or error-free at all times.

4. Service Agreements

Purchasing an active break programme requires a separate written service agreement specifying the package selected, session schedule, duration, pricing, payment terms, cancellation provisions, and any custom requirements. In the event of conflict between these Terms of Use and a signed service agreement, the service agreement prevails for matters relating to that specific engagement.

5. Client Responsibilities

Client organisations are responsible for providing safe and suitable spaces for on-site sessions, notifying facilitators of any relevant workplace hazards, ensuring employee participation is voluntary unless otherwise agreed, communicating session schedules to staff, and providing accurate contact and billing information. Clients must obtain any internal approvals required for third-party facilitators to access their premises.

6. Participant Conduct

Employees participating in active break sessions are expected to follow facilitator instructions, exercise personal judgement regarding their physical comfort and limitations, wear appropriate attire, and treat facilitators and fellow participants with respect. Tendoneoeco reserves the right to pause or discontinue sessions if conduct poses safety concerns.

7. Intellectual Property

All content on tendoneoeco.world, including text, graphics, logos, session plans, movement sequences, photographs, and software, is owned by or licensed to Tendoneoeco and protected by United Kingdom and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent, except for personal, non-commercial viewing of website pages.

8. Payment Terms

Package prices listed on our website are in British Pounds Sterling and exclude VAT unless otherwise stated. Invoices are payable within the period specified in the service agreement, typically thirty days from issue. Late payments may incur interest at the rate permitted under the Late Payment of Commercial Debts (Interest) Act 1998. We may suspend service delivery for accounts in material arrears.

9. Cancellation and Rescheduling

Session rescheduling requests must be submitted at least forty-eight hours before the scheduled start time. Cancellations with less notice may be charged at the full session rate. Programme-level cancellation terms, including minimum commitment periods and notice requirements, are set out in the service agreement and our Return Policy.

10. Limitation of Liability

To the fullest extent permitted by law, Tendoneoeco shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website or services. Our total liability for any claim relating to a service agreement shall not exceed the fees paid by the client for the three-month period preceding the claim. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

11. Indemnification

You agree to indemnify and hold harmless Tendoneoeco, its directors, employees, and facilitators from claims, damages, losses, and expenses arising from your breach of these terms, misuse of our website, or violation of applicable law, except where caused by our negligence or wilful misconduct.

12. Insurance

Tendoneoeco maintains public liability and professional indemnity insurance appropriate to the delivery of corporate active break programmes. Certificates of insurance are available upon request for client organisations requiring documentation for vendor approval processes.

13. Force Majeure

We shall not be liable for failure or delay in performing obligations due to events beyond our reasonable control, including natural disasters, pandemics, government restrictions, utility failures, civil unrest, or transport disruptions. Affected sessions will be rescheduled or credited in accordance with the service agreement.

14. Privacy

Your use of our website and services is also governed by our Privacy Policy and Cookies Policy, which describe how we collect and process personal data. By using our services, you acknowledge that you have read and understood those policies.

15. Governing Law

These Terms of Use are governed by the laws of England and Wales. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to mandatory consumer protection rights applicable in Scotland and Northern Ireland.
